- (a) The licensee may be required to submit to a state and federal criminal background check if the Arkansas State Board of Nursing deems it necessary.
(b) A waiver is not required for renewal of a license for an individual convicted of a crime listed in Arkansas Code § 17-3-102 if the licensee:
- (1) Has completed the waiver requirements at the time of initial licensure;
- (2) Was licensed prior to July 24, 2019; or
- (3) Attended a professional or occupational school, program, or training in pursuit of an occupational license before the enactment of subdivision (b)(1) of this section (July 24, 2019) and would have been qualified to hold an occupational license on or before July 24, 2019.
