17 CAR § 95-1303 – Criminal history check

(a) A licensee or registrant whose criminal history check from the Identification Bureau of the Division of Arkansas State Police reveals that the applicant has pleaded guilty or nolo contendere to or been found guilty of any offense listed in Arkansas Code § 17-3-102(a) or (e) shall not be eligible for renewal unless the reported offense has been:
1. (1) Expunged;
2. (2) Sealed; or
3. (3) Pardoned.
(b) A licensee or registrant may apply to the Arkansas Psychology Board for a waiver of disqualification pursuant to 17 CAR § 95-405(c)(3) for the conviction of any listed offense.
(c) A licensee deemed so ineligible may appeal this action through the process identified in 17 CAR § 95-1102.
