(b)

1. (1) All company owners, officers, directors, stockholders, partners, or members will be required to apply to the Identification Bureau of the Division of Arkansas State Police for a state and nationwide criminal records check to be conducted by the Federal Bureau of Investigation.
2. (2) The criminal records check will be required for any company licensee regardless of whether the owner or applicant is a licensed Arkansas bail bondsman.

(c)

1. (1) Changes in ownership or changes to the corporate structure of any Arkansas-licensed bail bond company shall be transmitted to the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board via a completed bail bond company application indicating the change.
2. (2) Criminal record checks will be submitted for those owners, officers, directors, stockholders, partners, or members not previously listed.

(d)

1. (1) Names of applicants for a bail bondsman license will be forwarded to sheriffs, police chiefs, and prosecutors for references.
2. (2) Negative replies shall be investigated to determine if licensing infractions exist.

(e)

1. (1) Company licensees will go through the same procedure as a bail bondsman licensee in regard to letters to:

   1. (A) Sheriffs;
   2. (B) Police chiefs; and
   3. (C) Prosecutors.

2. (2) This applies to all:

   1. (A) Sole proprietors;
   2. (B) Partners;
   3. (C) Stockholders;
   4. (D) Members; and
   5. (E) Officers.

(g)

1. (1) Fictitious names shall not be used in the bail bond business.
2. (2) Company applications containing fictitious names will be returned.
