A licensee may be exempt from the professional development education requirements for one (1) of the following reasons:

1. (1) New licensees by way of examination or comity shall be exempt for their first renewal period;

2. (2)

   1. (A) A licensee experiencing physical disability, illness, or other extenuating circumstances as reviewed and approved by the State Board of Licensure for Professional Engineers and Professional Surveyors may be exempt.
   2. (B) Supporting documentation must be furnished to the board;
3. (3) A licensee listed as “inactive” on the board-approved renewal form certifying that they are no longer receiving any remuneration from providing professional engineering or professional surveying services shall be exempt from the professional development hours required;

4. (4)

   1. (A) A professional surveyor may be exempt if he or she:

      1. (i) Is at least sixty (60) years of age; and
      2. (ii) Has twenty (20) years of acceptable professional experience.
   2. (B) This request must be submitted on forms supplied by the board; and

5. (5)

   1. (A) A professional engineer may be exempt if he or she:

      1. (i) Is at least sixty-five (65) years of age; and
      2. (ii) Has twenty-five (25) years of acceptable professional experience.
   2. (B) This request must be submitted on forms supplied by the board.
