(a) Written contract required.

1. (1) Any agreement to provide auctioneer services shall be reflected in a written contract.

2. (2) A contract may be a simple written agreement but shall include the following:

   1. (A) Date of agreement;
   2. (B) Specific date, time, and location of auction;
   3. (C) Special terms and conditions;
   4. (D) Commission charged;
   5. (E) Other expenses;
   6. (F) Signatures of auctioneer or auction house owner and seller or sellers;
   7. (G) Whether the auction is absolute or with reserve; and
   8. (H) Amount of any buyer’s premium to be charged.
