1. (a)

   1. (1) The Arkansas State Board of Athletic Training may refuse to license, refuse to renew a license, revoke a license or temporary permit, and/or take other disciplinary action as provided by law regarding any athletic trainer who is guilty of any of the acts set forth in Section 12 of the Arkansas Athletic Trainers Act, Acts 1995, No. 1279.
   2. (2) A revoked license must be returned to the Arkansas State Board of Athletic Training office immediately upon notification of the revocation.
   3. (3) The Arkansas State Board of Athletic Training is required to report the revocation to the Arkansas State Board of Athletic Training-approved certifying agency.
2. (b) Each facility offering athletic training services shall be required to publicly display the name and address of the Arkansas State Board of Athletic Training.

3. (c)

   1. (1) Any person may file a complaint in writing to the Arkansas State Board of Athletic Training against any licensed athletic trainer in this state, charging said person with having violated the provisions of any part of the Arkansas Athletic Trainers Act.
   2. (2) The Arkansas State Board of Athletic Training may act upon its own motion or upon the complaint of any individual in writing and signed by the complaining party.
   3. (3) The person named in the complaint (respondent) will be notified via certified mail issued within seven (7) working days from receipt of the written complaint at the Arkansas State Board of Athletic Training.

4. (d) The respondent shall be:

   1. (1) Provided twenty-one (21) calendar days in which to file a written response to the complaint; and
   2. (2) Advised that he or she is required to provide all documents and exhibits in support of his or her position.

5. (e) When a sanction ordered by the Arkansas State Board of Athletic Training becomes final under the Arkansas Administrative Procedure Act, Arkansas Code § 25-15-201 et seq., such information shall be publicly disseminated, including:

   1. (1) Notification to the Board of Certification; and

   2. (2)

      1. (A) A posting on the Arkansas State Board of Athletic Training’s website.
      2. (B) The posting shall include:

6. (i) The licensee’s name;

   1. (ii) A citation of the law or laws or statute or statutes violated;

      1. (iii) A brief description of the findings of fact; and

         1. (iv) A description of the sanction.

Codification Notes: The Arkansas Athletic Trainers Act, Acts 1995, No. 1279, is codified at Arkansas Code § 17-93-401 et seq. "BOC" means the Board of Certification for the Athletic Trainer.
