(a)
- (1) The State Board of Embalmers, Funeral Directors, Cemeteries, and Burial Services’ inspector shall inspect Type A, B, C, and D establishments for their initial inspection.
- (2) The inspection fee must be submitted with the application for the establishment license.
(b)
- (1) Reinspections are those inspections that are required due to significant changes.
(2) These changes include, but are not limited to:
- (A) An addition of an embalming preparation room;
- (B) Relocation of an embalming preparation room;
- (C) The addition of a retort;
- (D) A location change; or
- (E) A change in ownership.
- (3) Reinspections required due to significant changes require the payment of the reinspection fee, along with submission of the required forms.
(c)
- (1) The inspector shall inspect all Type A, B, C, and D establishments randomly throughout the year during normal business hours.
- (2) The inspector should be allowed to enter within a reasonable amount of time not to exceed one (1) hour.
(d)
- (1) If an inspection or reinspection is unsuccessful due to lack of cooperation of the establishment license holders, then the license holders will be subject to an inspection penalty fee of one hundred ($100) per hour after the initial hour.
- (2) Maximum wait shall be seven (7) hours or seven hundred dollars ($700) for each day of occurrence.
(e)
- (1) Public areas shall be inspected.
- (2) Each establishment shall have public restroom accommodations which shall be clean and in good working order.
- (3) Further, all public areas shall be kept in a good state of repair.
- (4) All sidewalks, entrances, and walkways shall be free from debris, ice, or other obstacles to the extent practicable.
(f)
- (1) If any establishment is cited for failure to comply with any requirements provided in statutes or board rules, when practicable, the establishment shall resolve the violation to the satisfaction of the board within thirty (30) days after the filing of the inspection report.
- (2) The establishment may be granted a longer period of time within which to resolve the violation, at the discretion of the board.
