17 CAR § 393-302 – Petition to initiate rulemaking

(a) Third parties may initiate rulemaking to adopt, amend, or repeal a rule by filing a petition with the agency to initiate rulemaking.
(b) The petition must contain the:
1. (1) Name, address, and telephone number of the petitioner;
2. (2) Specific rule or action requested; and
3. (3) Reasons for the rule or action requested.
(c) The petition to initiate rulemaking shall be filed with the State Board of Examiners of Alcoholism and Drug Abuse Counselors.
(d)
1. (1) Within thirty (30) days after submission of the petition, the agency will either:
  1. (A) Deny the petition, stating its reasons in writing; or
  2. (B) Initiate rulemaking.
2. (2) A special meeting will be called if necessary to meet this time frame.
