(a) General.

1. (1) Any person who contracts for or is engaged in well construction or pump installation shall hold or be employed by a person holding an Arkansas Water Well Contractor License.

2. (2) The water well contractor shall:

   1. (A) Hold the proper license, certificates, and permits for the type of construction engaged; and
   2. (B) Meet continuing education requirements as set forth herein.

(b) Categories for licenses:

1. (1)

   1. (A) Drilling and pump systems.
   2. (B) Includes contracting for all elements of water well construction, including drilling and pump installation;

2. (2)

   1. (A) Pump systems.
   2. (B) Includes contracting for the installation and repair of pumps and related equipment and does not include excavating the well;

3. (3)

   1. (A) Drilling.
   2. (B) Includes:

(i) Excavation of a water well;

1. (ii) Modification of the borehole;

   1. (iii) Setting or removal of casing up to the point of installing or repairing pumping equipment; and

      1. (iv) Plugging abandoned water wells;

2. (4)

   1. (A) Master electricians.
   2. (B) A master electrician holding a valid license may repair or install pressure switches, control boxes, and other electrical components of the pumping equipment at the well head without holding licenses issued by the Arkansas Natural Resources Commission.
   3. (C) The electrician shall adhere to this part for the installation and is not authorized to break the well seal or alter, cut, or drill into the casing; and

3. (5)

   1. (A) Master plumbers.
   2. (B) A master plumber holding a valid Master Plumber License may repair or install pressure switches, pressure tanks, valves, and pipes at the well head, without holding licenses issued by the commission.
   3. (C) The plumber shall adhere to this part for the installation and is not authorized to break the well seal or alter, cut, or drill into the casing.
