(a)
- (1) The victim received the medical-legal examination within ninety-six (96) hours of the attack or would have received the medical-legal examination within the required time except for good cause.
(2) Good cause includes, but is not limited to:
- (A) The physical incapacity of the victim;
- (B) The mental incompetence of the victim;
- (C) The age of the victim; or
- (D) The sexual assault was not reasonably discoverable.
(b)
- (1) The billing for the medical-legal examination is submitted to the Crime Victims Reparations Board within three (3) months of the medical-legal examination, unless the board finds good cause for failure to timely submit.
(2) Good cause includes, but is not limited to:
- (A) Restitution or other collateral source was terminated;
- (B) Verifiable postal service delays; and
- (C) Other good cause as determined by the board.
