Approval for acquisition of land or interests in land — Authority

(a)
- (1) The Arkansas Natural Heritage Commission is to acquire, by purchase, gift, devise, grant, dedication, as hereinafter defined, or otherwise, the fee or other interest in real property for inclusion in the system.
- (2) Arkansas Code § 15-23-308(2).
(b)
- (1) The commission has authority at its discretion either to retain fee title or to convey said title to such other agency or department of state government as the commission may select.
- (2) Arkansas Code § 15-20-308(2).
(c)
(1) The commission is authorized, with the advice and consent of the Legislative Council and the Governor, to:
- (A) Acquire, by purchase or otherwise, real property for the purpose of trade or exchange; and
- (B) Trade or exchange any such property acquired for lands to be included in the system of natural areas.
(2)
- (A) However, the commission shall exercise this power in such manner that any and all property acquired for the purpose of trade or exchange shall in fact be traded or exchanged forthwith and without delay.

(d)
- (1) The commission has the authority to purchase or receive, by gift, devise, grant, or dedication, conservation easements in real property for the protection of rivers and streams in the state.
