- (a) Borrowers will be required by the Arkansas Natural Resources Commission staff to perform value engineering if the estimated cost of building the wastewater facilities is twenty million dollars ($20,000,000) or more.
- (b) The borrower shall use current United States Environmental Protection Agency guidance on the scope and performance of the value engineering analysis, and the associated value engineering reports shall be submitted to the commission staff for review and approval.
(c)
- (1) Borrowers may not break up contracts to avoid this provision.
- (2) The commission staff may require borrowers to undertake a value engineering review if it believes this has happened.
