(a) Upon discovery of a deficiency that does not immediately threaten the dam’s safety, the Chief Engineer of the Arkansas Natural Resources Commission will issue a letter:
- (1) Specifying actions necessary to remedy the problem; and
- (2) Requesting a schedule for implementing the required actions.
- (b) Based on mutual agreement a consent order will be issued that will embody the agreed upon actions and timetable.
