- (a) If no public hearing is requested as a result of the public notice, the Director of the Arkansas Natural Resources Commission will either approve or deny the permit request.
- (b) If a public hearing is requested as a result of the public notice, the director will approve or deny the permit request based upon the evidence presented.
- (c) Prior to issuance of the permit, a Water Plan Compliance Certification must be obtained as prescribed in 15 CAR pt. 22, if applicable.
