(a)
- (1) Before water is deliberately impounded by closing drain gates on a newly constructed dam, an operation permit must be issued by the Arkansas Natural Resources Commission.
- (2) An operation permit will be issued by the Chief Engineer of the Arkansas Natural Resources Commission upon completion of final inspection and receipt of the Certificate of Substantial Compliance by the owner’s engineer.

- (b) An operation permit is required for all existing dams not exempted under 15 CAR § 23-103 or § 23-104.
