(a)

1. (1) When a project or portion of a project may physically or economically affect public water or wastewater systems within five (5) miles of any portion of the proposed project, the applicant shall notify all systems within five (5) miles of the project area by:

   1. (A) Certified mail; or
   2. (B) Personal delivery.
2. (2) The notification shall consist of the application submitted to the Director of the Arkansas Natural Resources Commission, along with all attachments thereto.

(c)

1. (1) Prior to a compliance determination, the applicant shall certify to the director that either:

   1. (A) There are no public water systems for which notification is required; or
   2. (B) Notification was given to named systems as required by this section.

2. (2) The applicant may be required to submit additional information such as:

   1. (A) The domestic return receipt;
   2. (B) An affidavit; or
   3. (C) Other proof of notice.
