Prior to the public hearing, the Arkansas Natural Resources Commission staff, in conjunction with other interested federal or state agencies, will make an investigation of the alleged water shortage, which shall include the following information:
- (1) Verification of information submitted by petitioner;
- (2) Water use requirements of all persons lawfully taking water from the stream;
- (3) Classification of diversions as either riparian or nonriparian;
- (4) Quantity of water in stream under varying flow levels;
- (5) Determination of in-stream beneficial uses and quantity of water required therefor;
- (6) Quantity of water available for diversion under varying flow levels; and
- (7) Quantity allowable to each diverter on a daily basis.
