- (a) A person shall be authorized to divert excess surface water for nonriparian use upon proper application and the granting of a permit by the Director of the Arkansas Natural Resources Commission.
(b)
- (1) The Arkansas Natural Resources Commission calculates excess surface water using the numbers identified at A-3 – A-4 of the Appendix.
- (2) These numbers may be decreased to reflect localized conditions and demonstrated changes in existing and projected water uses and instream requirements.
