(a)

1. (1) Records required to be compiled or kept by this part or by the provisions of any approved nutrient management plan shall be:

   1. (A) Maintained by the owner and operator of the lands within the nutrient management unit for a minimum period of five (5) years; and
   2. (B) Available for inspection by the Arkansas Natural Resources Commission or conservation district employees upon reasonable request.
2. (2) Such records shall not be public records.

(b)

1. (1) Records required to be compiled or kept by this part or by the provisions of any approved nutrient management plan relating to the activities of a nutrient applicator shall be:

   1. (A) Maintained by the nutrient applicator for a minimum period of five (5) years; and
   2. (B) Available for inspection by the commission or conservation district employees upon reasonable request.
2. (2) Such records shall not be public records.
