- (a) The depreciation reserve fund will be a restricted account, established and maintained by a third-party trustee or by the applicant, as approved by the Director of the Arkansas Natural Resources Commission.
(b)
- (1) This reserve fund is for the replacement of the financed project and shall not be used for any other purpose without the written approval of the Arkansas Natural Resources Commission.
- (2) It will be accumulated at a rate and amount established by the director.
