(a)

1. (1) Each installer who operates within the State of Arkansas, regardless of where the home office may be, shall be registered by the Department of Health.

2. (2) The registration will be issued by the department or its authorized agent upon:

   1. (A) Successful completion of an examination; and
   2. (B) Compliance with the provisions of this part.
3. (3) A registered installer shall be present at the job site during all phases of system construction.

4. (4) In order to maintain registration, an installer shall:

   1. (A) Attend at least one (1) annual training course approved by the department; and
   2. (B) Continue to demonstrate competency in practice to ensure the purpose of this part.
5. (5) The registration shall be renewable on January 1 of each year.
6. (6) Failure to renew by March 1 shall result in a late fee equal to one half (1/2) of the renewal fee.
7. (7) Failure to renew within a calendar year shall require reexamination in order to become registered.
8. (8) Installers licensed at the time of the effective date of this part will be exempt from the initial examination.

(b)

1. (1) The installer’s license may be revoked or suspended whenever any provision of this part is violated pursuant unto the Arkansas Administrative Procedure Act, Arkansas Code § 25-15-201 et seq.
2. (2) Each installer shall furnish proof of current registration upon request by an authorized agent of the department.

(d) Installer's registration fee.

1. (1) A fee of one hundred dollars ($100) shall be levied annually for the registration of each installer.

2. (2) The registration fee shall be:

   1. (A) Made payable to the department; and
   2. (B) Attached to the completed application and forwarded to the department.
