(a) To avoid all appearance of impropriety, no conservation district shall hire an employee:
- (1) To supervise or be supervised by a relative; and
- (2) Who is a relative of a district board member.
(b)
- (1) A relative shall be considered someone related to a supervisory employee or director within the third degree according to civil law.
- (2) To determine the degree of relationship, begin with one (1) of the individuals and count one (1) degree for each level of the genealogical chart up to the common ancestor, and then count one (1) degree for each level downward until the other individual is reached.
- (3) For example, brothers or brothers-in-law would be related to each other within the second degree.
- (c) Any employee hired prior to the effective date of this section is exempt from the application of this section.
