(a) After expiration of the time for submission of beaver control plans, the Department of Agriculture shall:

1. (1) Review the state funds available for the program in the current fiscal year; and
2. (2) Determine the funds available for the beaver control program.

(b)

1. (1) The department shall allocate the available funds to each district desiring to participate in the program.

2. (2) This allocation shall be based upon the:

   1. (A) District’s demonstrated need for beaver control; and
   2. (B) Probable success of the district's beaver control program.

3. (3) In making the allocation, the department may consider the following:

   1. (A) The beaver control plan;
   2. (B) The estimated number of beavers within the district;
   3. (C) The type and severity of damage;
   4. (D) The number of beavers harvested in the past under this or similar programs; and
   5. (E) Other factors to ensure equity in allocation.

(e)

1. (1) The department shall review the allocation of funds:

   1. (A) On or about April 1 of each year; or
   2. (B) As otherwise necessary to ensure that the funds are used as effectively as possible.
2. (2) No reduction in any participating district's allocation shall occur without prior notification to the district.
