(a)
- (1) At the written request of any party, the chair or member authorized by the Arkansas State Police Commission may issue subpoenas for the attendance of witnesses at the hearing.
- (2) The requesting party shall specify whether the witness is also requested to bring documents and reasonably identify said documents.
- (3) The executive secretary may prepare the subpoena.
(b)
(1) A subpoena may be served by any person:
- (A) Specified by law to serve process; or
- (B) Who is:
(i) Not a party; and
- (ii) Eighteen (18) years of age or older.
- (2) Delivering a copy to the person named in the subpoena shall make service.
- (3) Proof of service may be made by affidavit of the person making service.
(4) The party seeking the subpoena shall:
- (A) Have the burden of obtaining service of the process; and
(B) Be charged with the responsibility of tendering:
- (i) A witness fee of thirty dollars ($30.00) per witness; and
- (ii) Mileage fees at the current state mileage rate.
- (5) The witness must be served at least two (2) days prior to the hearing.
(6) For good cause, the commission may authorize the subpoena to be served fewer than two (2) days before the hearing.
- (c) Any motion to quash or limit the subpoena shall:
- (1) Be filed with the commission; and
- (2) State the grounds relied upon.
