The hearing officer will conduct the hearing in the following manner:

1. (1) Counsel for the Director of the Division of Arkansas State Police and counsel for the petitioner will give opening statements, briefly describing the nature of the proceedings;
2. (2) The case for the director’s disciplinary action will be presented first, followed by the case for the petitioner;
3. (3) The parties will otherwise be allowed to present their cases in the sequence determined by the hearing officer;

4. (4)

   1. (A) Each witness must be:

      1. (i) Sworn or affirmed by the hearing officer or the court reporter; and
      2. (ii) Subject to examination and cross-examination as well as questioning by the Arkansas State Police Commission.
   2. (B) The hearing officer may limit questioning in a manner consistent with the law; and
5. (5) When all parties and witnesses have been heard, parties may be given the opportunity to present final arguments.
