12 CAR § 10-508 – Motions

(a) All requests for relief will be by motion.
(b)
1. (1) Motions must be:
  1. (A) In writing; or
  2. (B) Made on the record during a hearing.
2. (2) A motion must fully state the:
  1. (A) Action requested; and
  2. (B) Grounds relied upon.
(c) The original written motion will be filed with the Arkansas State Police Commission by service on the executive secretary.
(d) When time allows, the other parties may, within seven (7) days of the service of the written motion, file a response in opposition.
(e)
1. (1) The hearing officer may conduct such proceedings and enter such orders as are deemed necessary to address issues raised by the motion.
2. (2) However, a hearing officer, other than the commission, will not enter a dispositive order unless expressly authorized to do so by the commission.
