(a)
- (1) An appeal hearing is initiated by the filing of a notice of appeal pursuant to Arkansas Code § 12-8-204(c).
- (2) Filing with the Director of the Division of Arkansas State Police shall be considered service of the notice on the Arkansas State Police Commission.
- (3) The commission shall set a hearing date to be held within a reasonable time.
(b) The notice of time and place of the hearing will be sent by:
- (1) United States mail to the petitioner’s latest address on file with the Division of Arkansas State Police; or
- (2) Personal delivery.
- (c) Notice will be mailed at least twenty (20) days before the scheduled hearing.
