(a) A full-time law enforcement officer, as defined by this part, who retires from an Arkansas law enforcement agency and serves as or is elected as constable within six (6) months of retirement from the law enforcement agency will not be required to complete the refresher course if that person:

1. (1) Is reappointed as a law enforcement officer as described by this part;

2. (2) Has successfully completed a minimum of twenty-four (24) hours of Arkansas Commission on Law Enforcement Standards and Training-certified training annually, to include:

   1. (A) Firearms qualification;
   2. (B) Duty to intervene; and
   3. (C) Racial profiling; and
3. (3) Has a nonforfeitable right to benefits under a State of Arkansas retirement plan.
