As used in this part and Arkansas Code § 11-3-203:

1. (1)

   1. (A) "Illegal drug" means any controlled substance which is unlawful for a particular employee or applicant to possess or use.
   2. (B) This includes prescription medication for which an employee or applicant does not have a current or valid prescription for use.
   3. (C) This also includes marijuana.

   4. (D) Alcohol shall be considered "illegal" for the purposes of this part if at the time of the test, the employer had a written policy which:

      1. (i) Prohibited alcohol use in the circumstances at issue;
      2. (ii) Established an alcohol testing procedure; and
      3. (iii) Established the concentration of alcohol which would be considered a positive test; and
2. (2) "Tests positive" means that there has been a positive test result on a confirmatory drug test as opposed to a screening test.
