As used in this part and Arkansas Code § 11-3-203:
(1)
- (A) "Illegal drug" means any controlled substance which is unlawful for a particular employee or applicant to possess or use.
- (B) This includes prescription medication for which an employee or applicant does not have a current or valid prescription for use.
- (C) This also includes marijuana.
(D) Alcohol shall be considered "illegal" for the purposes of this part if at the time of the test, the employer had a written policy which:
- (i) Prohibited alcohol use in the circumstances at issue;
- (ii) Established an alcohol testing procedure; and
- (iii) Established the concentration of alcohol which would be considered a positive test; and
- (2) "Tests positive" means that there has been a positive test result on a confirmatory drug test as opposed to a screening test.
