As used in this subpart, the following words have the following meanings:

1. (1) APPOINTING AUTHORITY. The city manager or as otherwise authorized pursuant to Section 45-8A-23.091.
2. (2) BOARD. The civil service board created by this subpart.
3. (3) CITY. The City of Anniston in Calhoun County.
4. (4) CIVIL SERVICE EMPLOYEE. Any person who is employed in the service of the city in the police department or fire department.
5. (5) GRANDFATHERED EMPLOYEE. Any person who is employed in the service of the city on April 2, 2014, in a position that is subject to the civil service system. A person to whom this subdivision applies shall remain a civil service employee for the purposes of this subpart unless the employee accepts a promotion or employment in a different position with the city, without regard to whether the different position was formerly subject to the civil service system, or unless the employee voluntarily opts-out of the civil service system through proper notice, as set forth in this subpart.
