(a) All classified employment with the authority shall be contingent upon all of the following:
- (1) Availability of funds.
- (2) The authority’s need for the work to be done.
- (3) The employee’s compliance with all rules, policies, and procedures established in accordance with this subpart.
- (4) Satisfactory job performance by the employee.
- (b) Each classified employee who has successfully completed a probationary period may not be separated from employment with the authority without a hearing before the appeals board pursuant to the rules and procedures adopted by the department, if he or she requests a hearing.
(c)
- (1) Notwithstanding this section, the executive director of the authority shall be appointed by the authority.
- (2) The executive director shall appoint individuals to serve as heads of departments within the authority.
