The secretary may issue an administrative subpoena to a communication common carrier or a communications service provider to compel production of business records if the records requested satisfy both of the following:

1. (1) Are local or long-distance toll records or subscriber information.
2. (2) Are material to an active investigation of a felony violation of the Alabama Uniform Controlled Substance Act, as provided in Chapter 2, being conducted by a special agent of the agency.
