1. (1) Procedure for appeal and review

   1. (a) In the event an application for approval is denied, an approval is revoked, or a renewal of an approval is denied, the aggrieved party may appeal to the Department for a fair hearing.
   2. (b) The decision or action of the Department on any fair hearing shall be final and binding.
   3. (c) Any aggrieved party is entitled to a review of the final decision or action by filing a petition for review with the Circuit Court of Montgomery County, Alabama, within thirty (30) days from the date of the final decision or action.
   4. (d) Notice and opportunity for a fair hearing and notice of right to counsel shall be given to the appellant by the Department, along with a copy of the Regulations and Procedures for Hearings.
