Administrative hearings will be offered and, if requested, held with regard to criminal convictions in either of the following situations.

1. (a) Where a determination of unsuitability has been made based upon an out-of-state or federal conviction determined to fall within the list of disqualifying convictions in Rule 660-5-46-.03(29) and (30); or
2. (b) Where a request for reversal of a determination of unsuitability has been denied.
