1. (1) Nursing facilities must monitor the admission of mentally ill residents to their facilities.

   1. (a) A nursing facility may not have more than fifty percent (50%) mentally ill residents which is based on the total population of the facility including public and private pay residents.
   2. (b) If a facility does have more than fifty percent (50%) mentally ill residents, it will be designated as an institution for mental diseases for Medicaid payment purposes.
