(1) Definitions. As used in these Rules, the following terms have the following meanings:
- (a) "Agent." Any individual with verified association to a Licensee who performs duties or responsibilities for the Licensee which are directly related to the license authorizations or obligations of the Licensee under the Act or these Rules. Such duties or responsibilities shall include, but not be limited to, performing work or having access to cannabis, a medical cannabis facility, or related equipment or supplies of the licensee.
- (b) "Registered Agent." An agent who has completed the registration process required by this rule. Any individual who is granted access to a Licensee’s facility and who is not a Registered Agent must comply with the visitor access requirements of these rules.
(2) Agent Registration Application; Licensee Verification. An agent seeking status as a Registered Agent must submit (1) a completed agent registration application electronically through the AMCC Application & Licensing Portal; and (2) on a form prescribed by the Commission, the Licensee’s verification of the agent’s association with the Licensee.
(3)Criminal Background Check Requirement; Disqualifying Offenses. An agent seeking status as a Registered Agent shall, as required by § 20-2A-59(a), Code of Alabama 1975 (as amended), submit to state and national criminal background checks performed, respectively, by the Alabama Law Enforcement Agency (“ALEA”) and the Federal Bureau of Investigation (“FBI”). The Licensee must verify that the Agent has no disqualifying pending charge or conviction as provided in § 20-2A-59(b), Code of Alabama 1975 (as amended).
- (4) Maintenance of Records. All applicable records regarding a Registered Agent, including but not limited to any and all criminal background checks of the Registered Agent, shall be maintained by the Licensee and, upon request, made available to the Commission, its employees, investigators, agents, or auditors.
- (5) Expiration and Renewal of Registered Agent Status; Revocation. A Registered Agent status shall expire one (1) year from the date of issuance. The Registered Agent must renew the registration on or before the expiration date, or thereafter submit a new agent registration application, by complying with the provisions of this rule. The Licensee shall immediately notify the Commission of any Registered Agent who is no longer associated with the Licensee such that Registered Agent status is no longer required or appropriate, and the Commission shall revoke the Registered Agent status. The Commission reserves the right to revoke any Registered Agent status for failure to comply with the Act or these rules.
