The Commissioner or another authorized representative of the Department may at any time refer any circumstances suggesting a willful violation of 18 U.S.C. §1033(e) by any individual or entity to the appropriate law enforcement agencies or prosecutorial authorities for further investigation, possible criminal prosecution, and/or proceedings to assess the civil penalty provided for in 18 U.S.C. §1034 in addition to any administrative or other action that the Commissioner or Department may take in light of the circumstances.
