The Commission may not issue an order modifying, approving, or disapproving an administrative action of the Agency without the concurrence of a majority of a quorum. A quorum shall be any eight of the twenty-one members of the Commission, as defined in Code of Ala. 1975, §§41-9-245. Recusal of a member of the Commission shall not affect the quorum.
