The terms and conditions of an expiring NPDES permit are automatically extended until the effective date a new NPDES permit if the permittee has submitted a timely and complete application for reissuance of an NPDES permit and the delay in permit issuance has not been caused by the actions of the permittee in accordance with subparagraph 335-6-6-.08(1)(k)8. and paragraph 335-6-6-.12(b).
