1. (1) Purpose. Rules 335-3-8-.39 through 335-3-8-.70 set forth the general, designated representative, allowance, and monitoring provisions for the Transport Rule (TR) NOx Ozone Season Trading Program under section 110 of the Clean Air Act, as a means of mitigating interstate transport of ozone and nitrogen oxides.

2. (2) Definitions. For the purpose of rules 335-3-8-.39 through 335-3-8-.70 the definitions listed in 40 CFR §97.802, Subpart BBBBB as of July 1, 2016, and October 26, 2016 (81 FR 74504), will apply.

   1. (a) “Department” shall mean the Alabama Department of Environmental Management.

   2. (b) Word, Phrase, and Rule Substitutions. For the purpose of rule 335-3-8-.39 substitute:

3. (3) Measurements, Abbreviations, and Acronyms. Measurements, abbreviations, and acronyms used in this rule and in rules 335-3-8-.39 through 335-3-8-.70 are defined as follows:

   1. (a) Btu - British thermal unit.
   2. (b) CO2 – carbon dioxide
   3. (c) H2O – water
   4. (d) hr – hour
   5. (e) kW – kilowatt electrical
   6. (f) kWh – kilowatt hour
   7. (g) lb – pound
   8. (h) mmBtu – million Btu
   9. (i) MWe – megawatt electrical
   10. (j) MWh – megawatt hour
   11. (k) NOx – nitrogen oxides
   12. (l) O2 – oxygen
   13. (m) ppm – parts per million
   14. (n) scfh – standard cubic feet per hour
   15. (o) SO2 – sulfur dioxide
   16. (p) yr – year
