1. (1) The Environmental Protection Agency Regulations, and the Appendices applicable thereto, governing the Acid Rain Program-Permits Regulation (40 CFR, Part 72 and Appendices) are incorporated by reference as they exist in 40 CFR Part 72, (July 1, 2006) except for the provisions found in 40 CFR §72.12 and 40 CFR §§72.70 through 72.74 which are excluded.

   1. (a) The materials incorporated by reference are available for purchase and inspection at the Department’s offices at 1400 Coliseum Boulevard, Montgomery, Alabama 36110.
2. (2) In the event of any inconsistency between the regulations contained in this chapter and regulations contained in other chapters of this administrative code, the provisions of this rule shall take precedence and shall govern the issuance, denial, revision, reopening, and renewal of the Acid Rain provisions of an operating permit.
3. (3) Definitions. For purposes of this Rule, the definitions listed in 40 CFR §72.2, Subpart A, will apply.
