The Department shall determine the priority for funding eligible projects to be included on the project priority list and included in the Departments Intended Use Plan and based on the criteria established in 33 USC 1296; and,

1. (a) whether the project promotes compliance with the Clean Water Act;
2. (b) the financial capability of the applicant;
3. (c) improvement to water quality;
4. (d) energy and water efficiency; and,
5. (e) sustainability of the project.
