Nothing in AS 17.20.332 — 17.20.338

1. (1) prevents the Department of Environmental Conservation from

   1. (A) conducting inspections necessary to investigate reports of

      1. (i) foodborne illness or food-caused injury or death;
      2. (ii) unsafe sanitary practices; or
      3. (iii) misbranded or adulterated food;
   2. (B) condemning and ordering the destruction of misbranded or adulterated food;
   3. (C) ordering the cessation of a practice or procedure of a producer that is unsafe, unsanitary, or otherwise a risk to public health;
   4. (D) regulating food or an establishment that is not exempt under AS 17.20.332 — 17.20.338; or
   5. (E) providing assistance, consultation, or inspection at the request of a producer;

2. (2) exempts a person from

   1. (A) applicable federal and local laws, regulations, and ordinances regarding food; or
   2. (B) brand inspection requirements under AS 03.40.250 or animal inspection requirements under AS 03.05.040.
