The lieutenant governor shall deny certification upon determining that

1. (1) the application is not substantially in the required form;
2. (2) there is an insufficient number of qualified sponsors; or
3. (3) more than 90 days have expired since the adjournment of the legislative session at which the act being referred was passed.
