(a) On the filing of an unopposed or joint motion, or on a stipulation signed by the parties, the chair may issue an order dismissing an appeal upon settlement. The unopposed or joint motion, or stipulation must
- (1) state the parties' agreement that the appeal be dismissed;
- (2) state the terms for allocating payment of fees and costs between the parties, including attorney fees and costs on appeal, as provided in AS 23.30.008(d); and
- (3) have an attached copy of the board-approved compromise and release agreement or settlement agreement if board approval of the settlement is required.
(b) The chair may issue an order dismissing an appeal on motion by a party that
- (1) states the reasons for dismissal;
- (2) states the terms for allocating payment of fees and costs between the parties, including attorney fees and costs on appeal, as provided in AS 23.30.008(d); and
- (3) has an attached copy of the board-approved compromise and release agreement or settlement agreement if board approval of the settlement is required.
