A child experiencing an emotional disturbance is an individual under 21 years of age who is experiencing a nonpersistent mental, emotional, or behavioral disorder that

1. (1) is identified and diagnosed during a professional behavioral health assessment under 7 AAC 135.110; and
2. (2) is not the result of intellectual, physical, or sensory deficits.
