(a) For the purpose of determining eligibility under 7 AAC 100.312(a)(2)(A), the department considers a child to have health insurance if that child is covered by
- (1) individual health insurance;
- (2) governmental or private group health insurance;
- (3) a group managed care or preferred-provider health plan;
- (4) Medicare;
- (5) Medicaid;
- (6) TRICARE or another military-sponsored health plan;
- (7) a state high-risk insurance pool;
- (8) a public health plan established or maintained by a state or local government; or
- (9) a health benefit plan under 22 U.S.C. 2504(e) (Peace Corps Act) provided for Peace Corps volunteers.
(b) The following do not constitute health insurance for the purpose of determining eligibility under 7 AAC 100.312(a):
- (1) a dental plan, vision plan, or other coverage that is limited to a single type of service;
- (2) coverage provided through the United States Department of Health and Human Services, Indian Health Service, or through tribal organizations funded in whole or in part by the Indian Health Service;
- (3) workers' compensation;
- (4) automobile insurance;
- (5) homeowner insurance;
- (6) general liability insurance.
- (c) A child is insured under (a) of this section regardless of whether the health plan requires cost-sharing of any amount or does not cover a particular illness or procedure the child needs.
