(a) To be eligible as a special low-income Medicare beneficiary qualifying individual under 7 AAC 100.002(e)(4), an individual must
- (1) be eligible for and enrolled in Medicare Part A hospitalization coverage;
- (2) have total monthly income that does not exceed 135 percent of the federal poverty guidelines for this state, adopted by reference in 7 AAC 100.980;
- (3) have countable resources that do not exceed $4,000 for an individual living alone or $6,000 for spouses living together; and
- (4) meet all other nonfinancial eligibility requirements under 7 AAC 100.400.
- (b) Coverage for an individual eligible under this section is limited to payment of the individual's Medicare Part B premiums.
- (c) An individual that the department determines is eligible under this section may apply for up to three months of retroactive eligibility under 7 AAC 100.072, but retroactive eligibility is not available for any month before January 1 of the year in which the individual applies for retroactive eligibility.
- (d) The department will provide coverage under this eligibility category until the department reaches the annual spending limit established under 42 U.S.C. 1396u-3. If the department reaches the spending limit under 42 U.S.C. 1396u-3 before the end of a calendar year, the department will stop determining eligibility under this eligibility category, but will instead determine eligibility under 7 AAC 100.754.
