(a) The home maintenance allowance is the amount of the recipient's income deducted from the recipient's total monthly income to maintain the recipient's home while the recipient is in a medical institution. This section applies only to an individual who
- (1) was residing in the home immediately before admission to the medical institution;
- (2) does not have a community spouse or dependent child; and
- (3) is expected to remain in the medical institution for six months or less.
- (b) The maximum home maintenance allowance permitted under this section is equal to the income eligibility standard under 7 AAC 40.310(a) and (c) for an individual living independently. The home maintenance allowance may be deducted for a maximum of six months, beginning with the month following the month of admission to the medical institution.
- (c) A recipient must provide the department with a written certification from the recipient's primary physician that the recipient is expected to remain in the medical institution for six months or less.
