Enforcement actions and plans of correction

- (a) Under AS 47.32.120, 47.32.130, and 47.32.140, the department may take an enforcement action based upon the result of an inspection or investigation.
- (b) Not later than 14 days after receiving notice under AS 47.32.140(b) from the department, the licensee must make the allegation of compliance under AS 47.32.140(b) or enter into a plan of correction under AS 47.32.140(b) and (c). A plan of correction must indicate the steps that licensee must take to meet the requirements of this chapter.
- (c) If a licensee fails to submit an acceptable plan of correction, the licensee may be subject to further enforcement actions under AS 47.32.140.
- (d) If the department revokes a license under AS 47.32.140(d), the department will not accept a plan of correction from the date of revocation.
- (e) A licensee may appeal the decision by the department to revoke a license under AS 47.32. If a licensee appeals the decision by the department to revoke a license under AS 47.32.130, 47.32.140, and 47.32.150, the department will not place children in the foster home or issue foster care payments until the final agency decision is received.
